1. Overview

By enrolling in the Eve’s Coaching Package (“the Program”), you (“Client”) agree to the following Terms and Conditions (“Agreement”) with The Cabin Fairy LLC (“Provider,” “we,” “us,” or “our”). This Agreement outlines the terms under which coaching, consulting, and design guidance are delivered as part of the Eve’s Coaching Package.

2. Program Description

Eve’s Coaching Package is a subscription-based service designed to support short-term rental (STR) owners from Closing Day to Booking Day. Services include:

• Property Walk-Through & Design Plan

• Custom STR Launch Timeline

• Design & Décor Curation

• Vendor Sourcing

• Staging & Photo Prep

• Listing Creation

• “Fairy Dust Touch” – Personalized guest experience strategy, Welcome Book, and launch checklist

Services are performed in collaboration with the Client, using the information and access provided by the Client.

3. Payment Terms

• The monthly investment is $997 USD, billed automatically each month via the payment method provided.

• This is a month-to-month subscription with no long-term contract.

• Payment is due in advance of service delivery each month.

• Failure to complete payment may result in a pause or termination of services.

4. Refund Policy

All payments are non-refundable. Due to the customized and time-based nature of the Program, no refunds or credits are provided under any circumstances, including for partial months or unused services.

5. Cancellation Policy

Clients may cancel the subscription at any time with a 14-day written notice before the next billing date. All requests for cancellation must be submitted in writing via email to [email protected].

Once cancelled, services will continue through the end of the current billing period and will not renew.

6. Client Responsibilities

To ensure a smooth and successful experience, the Client agrees to:

• Provide timely access to the property for walkthroughs, staging, and photography.

• Communicate promptly via email or phone as needed.

• Approve design elements and vendor selections within reasonable timelines.

• Pay all third-party vendor fees directly, unless otherwise agreed in writing.

• Maintain appropriate insurance and legal compliance for the property.

7. Intellectual Property

All materials, tools, templates, photos, vendor lists, design plans, and other proprietary content created or shared by The Cabin Fairy LLC remain the intellectual property of the Provider unless otherwise specified in writing.

Clients receive personal, limited-use rights to materials shared during the coaching relationship for their own property or business use. These materials may not be reproduced, resold, or distributed without written consent.

Shared templates or editable tools provided as part of the service may be used and customized by the Client.

8. Communication & Availability

All official communication will occur through email ([email protected]) or by phone at (828) 508-7143. Typical response times are within 1–2 business days, Monday through Friday. Virtual meetings or calls may be scheduled as needed to support the coaching process.

9. Results Disclaimer

The Cabin Fairy LLC does not guarantee specific financial, occupancy, or booking results. Client success depends on multiple factors outside the Provider’s control, including property condition, location, market demand, and Client implementation.

10. Limitation of Liability

In no event shall The Cabin Fairy LLC or its representatives be liable for any indirect, incidental, or consequential damages arising from this Agreement. Total liability under this Agreement shall not exceed the total amount paid by the Client for one (1) month of service.

11. Confidentiality

Both parties agree to maintain confidentiality regarding any sensitive business or property information shared during the course of the Program. Client testimonials, photos, or design work may be featured in marketing materials only with written consent.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in Maggie Valley, NC.

13. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior proposals, communications, and agreements. No modification of this Agreement shall be valid unless made in writing and agreed to by both parties.

14. Acceptance

By enrolling in or paying for the Eve’s Coaching Package, the Client acknowledges they have read, understood, and agree to abide by these Terms and Conditions.
